Where do I start?

Business 2 views 4 answers
My husband and I have entered into talks of a divorce. I have been a stay at home mom for 8+ years, I will be moving from OH to WA where my family lives so that I can have so help while I get on my feet. The kids will be coming with me. He has taken my car, I have no access to any vehicle, he recently shut my cell phone off, and has just left. I have no idea what to do, what my "rights" are, or even where to start. ANY advice will be wonderful

Step one - get to an attorney. Now. Sounds like this is going to get ugly.

Use the Find a lawyer tab located at the top of the screen to locate an experienced divorce attorney. I wish you the best.

Actually, the difficult part is going to be taking the children if there's a divorce. It's difficult to answer questions regarding rights without much more detail and the best way to do that is to have a consultation with a divorce attorney in the Columbus area. Many attorneys offer a free consultation. I know your cell is shut off but try to enlist a friend and get an appointment set up Monday.

You face a number of issues. If you move without a custody order from Ohio you must establish residence in Washington before you can file for divorce there, usually six months. In the meantime your husband could file for divorce in Ohio and you would have to defend it here. If you file before you go you can try to have a child support order in place before you go, but it may be difficult for you to leave, since the father is entitled to visitation. You really need to talk to a local attorney before making a move.
