While not excessive, 40% is still on the high range of what you should be paying in a contingency fee agreement. For the most part the industry standard based on my experience has been about 1/3 or 33.3 percent. However, there are also quite a few other questions that would change the analysis, who is the lawyer, experience, success rate, location, case difficulty, reputation, is your case in litigation, etc. I have even seen some Personal Injury Attorney fees as low as 25%, but be weary if it is to low because like anything else you get what you pay for.

Every case is different and so are lawyers. If you shop for the lowest price, you often get what you pay for. Having said that, there is no hard and fast rule about what i stoo much, too littl eor not enough. Because lawyers who work on a contingency fee take a risk in time and money, even at 40% or more they can still lose a lot of money depending on how the case turns out. Sometimes the facts of the case influence it, sometimes the amount of insurance coverage, nature and likeability of the client or opponent, or the state of the law (whether the damages are capped or in some way limited; whether there are other legal obstacles that make th ecase more complicated and expensive). For serious personal injury cases that go into litigation, 40% is fairly standard. Some states have fee schedules or caps, imposed either by the state bar associationourt, or by statute. If you have a concern about the fee, speak with a few qualified and experienced trial lawyers. But make sure you know what you are getting -- find out what their qualifications and experience is, whether they are board certified, do they teach or write, have they had substantial trial experience, etc. Then you can decide whether 40% is too high or appropriate.
