Can I turn off power, lights, and cable if my husband still lives in the house? The utilities are in my name.

My husband and I have been separated for approx 2 months. I have relocated a couple of hours away and have rented a new place near my current employer. My husband is still living in our house and has not contributed to household expenses in the last several years. He is working part time (2 - 3 days per week). He just recently (since our separation) started looking for more work. I've indicated that I'd like to rent out our house or sell it, and he does not agree to it because he wants to remain there. I cannot afford to pay in both places. What are my rights? Thanks.

The first thing I would suggest you do is tell your husband you can no longer afford to pay for two homes and he has to start making mortgage payments and utility payments. Let him know you are removing your name from the utility services, including electricity, cable, garbage, etc. by a date certain (I would think one more cycle of payments) and then do it at that time. He will get the idea because the utility company will cancel the services unless he starts paying.. Be sure to put it in writing to him and to the utility companies when you have your account closed so there is no mistake about obligations. The other issue, ownership of the home, is something that has to be agreed or handled in the divorce. You really ought to have a lawyer helping you with this.

I strongly suggest you contact a local attorney in regards to these questions. Certain counties in Florida have Standing Administrative Orders that cover these issues in the even that the parties are currently in the middle of a pending dissolution of marriage action (divorce action). Many attorneys here on will offer a free initial consultation.
