Your friend should definitely consult with an experienced attorney in his or her area. There are strict time limits on filing a case for malpractice, so it would be good to contact an attorney right away.
Before surgery there are usually some sort of "consent form" they have to sign that lists potential complications and explains that a successful outcome is not guaranteed. Every surgery comes with inherent risk; and no surgeon is perfect. The question in medical malpractice is did they perform to the standards of their practice area (both "specialty" and geographic area). If there is a true concern that they did not; and did something sub-standard; a medical malpractice attorney will hire a similar surgeon in the same specialty and geographic location to review the records and determine if there was negligence or sub-standard care. If so; then there is potentially a case there. Hope that helps.
