Can the cps substantiate a case 6 months after the 60 days are up? Can the cps request TLC without substantiation?
My family needs help from someone who really cares and doesnt have a problem going after the state. My cps worker lied on his reasons for removal we have all the evidence needed to prove so and were planning on doing so in court next month, I'm nervous cause we are seeing the same judge that has been incredibly rude to me. After 6 months now of heartache and toil I'm being told that they are going to ask for another 6 months of TLC. I then do extensive research night and day for weeks on the Internet to find that it's a condition precedent that the department has substantion before requesting TLC. Both my cases are timed out not done in the 60 days. I emailed the ombudsman then I asked about that and how this can be done and where my substantiation letter is.. 6 days later I received a letter in the regular mail amongst the phone book and the coupons. I'm substantiated for neglect on September 20 from a case that began Feb 3.. from an office that's in another jurisdiction from a worker who hasn't been my worker for 2 months.. is this legal somehow? Don't they only have 60 days? And if a judicial determination wasn't made within 60 days of removal shouldn't i get my kids back?
