New York State Labor Law Re Resignation and Collection of Final Wages Owed

1 views 2 answers
I understand New York is "employment at will." For the employee, this means I can resign or quit without giving 2 weeks notice.I understand giving "notice" is a courtesy. This was a nasty, malicious and verbally abusive employer which is the reason why I did not give 2 weeks notice as I did not want to go through 2 more weeks of abuse and the possibility of him not paying me anyway.I just provided him with a written, immediate resignation letter and left immediately. His attitude was that he was "owed" his 2 weeks and he was upset I did not give it to him;he may not pay for the last week of work out of spite. There was no written or verbal agreement that I would provide any notice on termination/resignation.What is my recourse against him?

If he does not pay you for time worked you can file a claim with the NYS Dept of Labor for unpaid wages.

I have successfully filed lawsuits for just the above type cases, whatever the circumstances of your leaving the employer owes you the money for the time worked. They cannot withhold wages out of spite or even if you left in a negative way. If you let me file a suit against the person you can almost be sure you will have your paycheck as soon as the court serves notice on the employer, as they will immediately cave. If they don't you will receive a judgment and be able to go after them that way but 99 out of 100 cave and give you the check as soon as they get notice of the suit. Please contact me, my rates for this type of work are extremely reasonable. Regards, Nick Misiti, Esq. 716 830 7960 [email protected]
