DUI:Bail money return and Restricted License

DUI 2 views 4 answers
My friend paid full amount of $2500 for my bail for DUI ( first offense no accidents) and my case has proceeded up to arraignment so far, I am waiting on my court date, my attorney waived my presence. When will I get the bail money back? I have served the 30 day suspension on my license but since I am waiting for my first case hearing date, how can I drive ( whether I am convicted or acquitted ) till then? Can I apply for a restricted license before the case hearing? I also have a out of state license which is so far not suspended, can I drive on that?

Assuming that the entire bail amount was $2,500 you will get the money back at the conclusion of your criminal case. However, if the amount of the bail was actually $25,000 and you paid $2,500 to a bail bondsman than that money is gone for good. If you have already completed your 30 day suspension you can apply for a restricted license for the remaining 3 month restriction. Understand that the restricted license only allows you to drive to and from work and your alcohol classes. Robert Driessen

If your friend posted an all cash bail you will get it back when your case is over. If he used a bail bondsman the amount he paid is the cost of the bonding service and he will not get it back. You can apply for a restricted license now; you do not need to wait until the conclusion of the criminal proceedings.

You can apply for a restricted license after the 30 following your arrest have passed. As for your bail, the bail amount will be returned to you once the case is done. Good luck.

The attorneys above are both correct, but I am wondering if you have retained an attorney why are you not asking him or her these important questions?
