Landlord says we havent paid rent for three months but we have receipts. What do we do.

The landlord that we are renting through says that we owe $1260 for rent that was not paid for March, April and May. However, we have receipts for all three months that total $900. Therefore we owe $390, which we got a money order for on June 4. My boyfriend talked to their lawyer and told him we had the receipts and we faxed a copy of the receipts and the money order. When I tried to pay the remaining balance the landlord refused to accept it because it was not for the full amount of $1260. This has happened to us once before where they said we did not pay rent. We pay in cash and I watch the recepionist put the money in the envople with the pink receipt that goes to accounting. What do we do?

If the landlord brings a lawsuit to evict you for non-payment of rent, you have a right to deposit the amount of rent in dispute with the court registry so you can stay in the property until the case is heard and the court can determine who is correct as far as the dispute over payment of rent. When you are served with a Summons, it should have information about your right to deposit the disputed rent with the court. You can also ask the court clerk about the procedure for depositing the disputed rent. In addition, the courts have programs to assist tenants being evicted, and you might get some direction from them.
