I was arrested for a dui on a military instilation. my drivers lcense was not revoked or suspended and my fine was 250 dollars. i have recently been arrested for a dui in Illinois. my question is if my first dui on the military instulation did not go against my driving record and i wasnt suspended or revoked can i get a court supervision on my dui in illinois. Will my dui on military instulation show up on my backround check
You have actually asked several questions. First, if you have previously been convicted of, or given supervision for, a dui, then you cannot get supervision again. Your next question is: Will anyone find out about my prior DUI? This cannot be answered, because it would depend on knowing what records will be searched. The lawyer will have to operate under the assumption that the prior DUI will be found, though.
I agree that you should seek counsel in the area to assist you.
Based on your location I presume that you have an Illinois license. Preliminarily, you can investigate whether or not your prior offense will appear on your record by obtaining a copy of your driving abstract (for court purposes) from the Secretary of State drivers' facility. If it shows up, that ensures that the prosecutor and judge will be aware of it.
If your prior dui is discovered, you may be able to negotiate some alternative to a conviction for dui (which will result in a license revocation, not merely a suspension.) In short, if you hope to retain your driving privileges, you should seek counsel immediately.
