Anonymous2 views3 answers
I have 10 days left on 5 years deferred adjudication probation. All fees, fines, and community service is complete. I had to attend a therapy class while on probation. Been in 1 for four and a half years and I was one class away before finishing. I had to moce and npw the therapist in my new class is saying I have not learned any thing and has made a recomendation to my home county to extend. I'm out of orange county Texas but living in Montgomery county.
Your probation officer can file to have your probation extended but must do so before your probation terminates. You may want to call your probation officer to see if they are ready to release you or not.
The judge can extend your probation 5 additional years, and then another 10 after that. (Total of 20 years on a felony offense.)
You are required to "pass" their courses as they see a "pass". Many times, particularly on sex offenses, the classes are almost impossible to finish. To "pass" also requires the right "can do" and "I am trying" attitude.
The final decision is the judge's, although most judges rely heavily on the recommendation of their court liason officer (CLO). If you have a really good relationship with your original probation officer, then it may not happen. Try talking to her / him about their position on an extension.
Yes they can.
