Where to file medical malpractice case?

Should I file the medical malpractice case in state of occurrence (NC) or since I live in GA should I file here? Would an attorney from GA handle a case in NC? I need the correct protocol. Thank you.

Usually you must file where the malpractice occurred. A lawyer in Georgia will not be able to handle a North Carolina case since he probably will not be admitted to practice in NC. Further, you will have to file suit in NC. Contact a local NC medical malpractice attorney to evaluate the medical records & advise you if you even a case of merit. First things first. You as a client don't even need to worry about where to file as your lawyer will know that and advise you. Good luck

Sounds like you need to file in NC, since both the act and the medical provider seem to be there. Post questions to or look up a malpractice lawyer near where the act occurred to find an attorney, then call them and give them specifics.

It appears that from the information you have provided that the med mal case would be filed in North Carolina. You should probably consider hiring a Georgia attorney who would probably associate a North Carolina attorney to assist with the case. It is difficult for the client and an attorney in another state to work very closely together simply because of the distance involved. it is usually helpful to have an attorney close to where you live so that you can communicate with that attorney who would be a liaison between you and the North Carolina attorney.
