Is it legal to not have heat in a apartment in Rhode Island?

My girlfriend and I go to school in Rhode Island we have been living in this apartment since early September. We are first time renters and I guess it didn't even cross my mind at the time that I didn't notice any heating in my apartment. There is also no stove fan so if we're cooking and things get a little smokey the smoke detector will go off. Is any of this legal??? We are students with barely any money but definitely not enough to take this guy to court.

It is not. Call the town or city building inspector immediately. Consult with an attorney about moving out.

Without a working heating system, a residential lease may not be considered habitable, especially during the winter months. If you cannot get the landlord to resolve the situation, get an estimate for the costs and explore repair and deduct options or find another place with heat. That is no way to live. I hope you get warm soon.

Generally, a landlord must provide a source of heat the tenant can use. So a furnace the tenants can put oil or gas in or electric heat the tenants can pay for.
