With due respect to my colleague, under certain circumstances, a Court can order that payment of child support be made directly to the child. The child would not "emancipate" him or herself, as this would mean they are not entitled to support. I recently handled a support matter where the child was being supported directly by the non-custodial parent (all living and educational expenses being paid, and money being provided directly to the child by deposit into the child's bank account) and no support was ordered to be paid to the "custodial" parent. It is therefore possible under the right circumstances. Please consult with an attorney. LEGAL DISCLAIMER Mr. Rosen practices matrimonial and family law in Great Neck, NY.
