You are facing serious consequences including license suspension, possible jail, possible probation, fines, fees and problems that will follow you for years to come. You need a lawyer who is experienced in DUI cases. There may be defenses to your case, but you are unlikely to have either the training or skills to find or present them. If you can't afford a lawyer, ask the court to appoint one.

You've got a mess on your hands, but there might be some good news. First, the suspended license: They're going to hold your priors against you when deciding what to do with you on the suspended license charge. You're likely facing some jail time. If your priors are also probation violations, then it can add up quickly. For that reason alone, you need an attorney to represent you, since you're looking at jail time. Aside from that, you may have a defense to the DUI. They must prove that you were driving under the influence. There are limited circumstances they can arrest you for DUI without seeing you drive, but I'm not seeing an exception here based on what you wrote. The entire case will need to be reviewed by an attorney and discussed in an in-person consultation. Don't ignore the 10 day window to request a hearing with the DMV to contest the suspension of your license. The issues overlap, so the same attorney can advise you about the DMV procedures as well.

You may be charged with driving on a suspended license and driving under the influence. For a first time DUI conviction, the potential sentence is between 2 and 180 days in county jail. You can also be ordered to pay a fine, attend alcohol education classes, and have your license suspended 6 months. Based on the facts you provided, you should obtain the assistance of an attorney to help with the case. If you are unable to retain a private attorney, you may request the public defender be appointed to assist you at your arraignment. The best Riverside attorney for this is Don Bartell 951 788-2230. Good luck. I otherwise agree with counsel.
