Having lower back pain

Business 8 views 2 answers
Was put out of work due to my Dr. Asked employer to restrict the amount of walking that is done. Employer gave me Fmla papers with short term diability instructed to go home. Been out of work since November 4 ,2016 to present. Insurance company for short term diability is due to stop weekly payments on January 10th 2017. Still under the Dr's care with just having an MRI. What are my options. Have almost deleted all my funds with also being a dietetic.

Wisconsin law also has a provision for disability discrimination that can, in some circumstances, cover more conditions that the ADA. You may want to consult with a Wisconsin licensed attorney about your circumstances to fully understand your options. These issues are always very fact dependent.

FMLA generally protects your job for up to 12 weeks of unpaid leave. Once that time is over, your employer can terminate your employment if you are not able to return to work. If your doctor says you can return to work with restrictions on walking, than you should ask your employer, in writing, to ACCOMMODATE your restrictions and offer a plan for how you could perform your job with less walking, perform lite duty, or get reassigned to a position that does not require as much walking. If your medical condition can be considered a disability under the American's with Disability Act (ADA), then your employer has a duty to engage in an interactive process to see if they can accommodate your return to work. It has recently been found illegal to prohibit all employees from returning to work unless they are 100% healed. On the other hand, if your medical condition is one that prevents you from being able to work, you should look in to long term or social security disability. There may be disability attorneys willing to give you a free consultation. Also - If you happened to be injured at work, you should consult with a worker's comp attorney to see if you have a case.
