Liability in rear end/rear side panel collision in subdivision

2 views 2 answers
My husband and I drove from our upper drive to lower drive(have a circular driveway). Just as we passed the lower driveway, I said to him "you forgot to close the garage door" of the lower garage. He stopped the car, glanced in rear view mirror, hesitated, then I said, "yes you need to close the door, we will be gone awhile". He then glanced in the side mirror and started to turn vehicle to back up. At that point, our teenage neighbor ran into the back/side panel of our car. My husband got out of the car and said to the kid that he "my husband" was responsible because he did not see him in mirror. I do not feel he is responsible and want to know if we have a case against the other driver that hit us. This boy is notorious for speeding in the neighborhood and his father does nothing

You did not say a lot about damages, if any. Report this to your insurance company and let them deal with it. It is why we all pay our premiums every month. That the boy is notorious for speeding in the neighborhood and his father does nothing is not relevant. THe only thing that is relevant is what happened at that time at that place. I truly wish you the best. This answer is provided for informational purposes only. First, your husband should have contacted his insurance company. Second, was the police called to do an investigation and complete a report. Third, it is difficult to visualize the accident without a diagram.
