Can I file a workers compensation claim?

Business 3 views 4 answers
I hurt my back at work 10 years ago and i have always been having back pain and i just hurt my back again and had to get back surgery. I went to a chiropractor and he said it was from the 2007 injury. So we re-opened the claim through my previous job. Workers compensation had an independent evaluation and they came to the conclusion that it was from 2016 so it was denied. I told my current boss to file the workers comp. claim through him and now he refuses to. He even said he wont because that would screw him up for life. I need some advice on what to do.

If the doctors feel that your current job is the cause for the need for treatment then you should file a new claim, failing to do so can only hurt you. I would suggest you meet with an attorney and go over what needs to be done. The employers insurance carrier will still likely argue that it relates back so you will be caught in the middle.

The answer is clear. You need to hire a good local workers' compensation lawyer to help you. The insurance company is not going to do anything to help you now unless and until you force them to with the help of a lawyer. I agree with Mr. Connell that you probably need to file a claim for the 2016 incident too, but get some local, specific legal advice first.

You should contact a Wisconsin worker's compensation attorney for a free consultation. It will take getting more information and reviewing medical records to know the best way to proceed. Though you back condition may be caused only by one job or the other, it is also possible to bring a claim that it is related to both. That will depend on the opinions of your doctors. Your employer cannot refuse to file a WC claim. You can contact Wisocinsin Department of Workforce Development, find out who the worker's compensation carrier is, and file a claim directly with the insurance company if it comes to it, but again, I recommend getting a free consultation with a Wisconsin worker's compensation attorney as soon as you can. Attorneys cannot directly offer you services here. You can use both 's "Find a Lawyer" tool and Google to research your options. Best of luck.
