N-400 USCIS Early Filing

Business 5 views 3 answers
Just saw that there's an Early Filing possibility for naturalization. I'm a permanent resident that will mark the 3 year anniversary (I got married to a US Citizen) in July. Would my case fall under the 316 (a) of the INA to early file my petition?

The three year benefit is from the date of the green card issuance not the date of marriage.

If you are about to hit the 3rd anniversary of getting your green card, have been married to a US citizen for the whole time and living together under the same roof, yes, you could file under the 3-year rule. In fact, you could file N-400 during the 90-day period ending on the anniversary (starting sometime in April). But if you divorce/get separated while the case is pending, then you cannot use the 3-year rule.
