It depends on the facts. Seek an experienced personal trial lawyer for a free initial consultation. rates lawyers and has a search function. Also look at the lawyer's Peer Review Rating™ in the Martindale Hubbell Legal Directory. You can also look for board certified trial lawyers at http://tbls.org.

Potentially. It is hard to offer better feedback without more information. I would strongly encourage you to consult with a personal injury attorney. He/she can consult with you, explore all the issues and give you a better idea of what to expect. Most, if not all, personal injury attorneys offer a free initial consultation and take cases on a contingency fee basis.

First off, I can't tell you how sorry I am this happened to you. As far as the company being liable, it is very possible. A negligent hiring claim, a personal injury claim, or other possibles are likely. You should consult with an experienced lawyer immediately. Since the culprit is already in jail and has plead guilty, I'm assuming this happened some moths ago. Call a lawyer, many of us will consult with you free of charge, and the case won't cost you anything up front. Good luck, hope I helped.

Maybe. If the company did not properly vet the employee and he has a record, you may have a case. Contact a Board Certified Personal Injury Specialist to investigate.

That is a very tough problem. Any private investigator would need to dig in and search. What they would be looking for his previous incidents that would put the employer at some kind of notice

I admire your strength in surviving this tragedy. The driving service may have insurance coverage that you are entitled to a recovery under without having to pursue claim against the company. You need to immediately contact a lawyer ASAP to discuss the facts of the incident and start investigating your remedies. The company itself may be liable as well; however, this can get tricky. Bad guys to not apply for jobs and tell their employers that they are bad guys, but if the company did not have a screening process to weed out bad guys, or ignored clear signs that the driver was a bad guy, you could show the company liable. Pushing one of these types of cases is not clear-cut so you need to talk to a lawyer ASAP.

The Company may be liable if they were negligent in regard to the driver. A company is not automatically liable for violent criminal acts committed by its employees, but they can often be held liable for things such as negligent supervision, hiring, training, poor background checks, etc... You need to consult with a qualified personal injury attorney ASAP to get all of your questions answered. Sorry that you went through this tragic event. I hope that the driver is in prison learning what it is like to be a victim.

Maybe. Companies typically try to say the driver was an independent contractor and so the company isn't liable, so find a lawyer who knows what to do about that. Someone board certified in personal injury law, 10 rating and Martindale Hubble rating of AV are good places to start.

The company impossibly liable for negligent hiring and retention. This would depend on his prior record.

I am so sorry this has happened. You should definitely speak with a personal injury attorney. Naturally, it will depend on the facts of the case and a good attorney will investigate and let you know if you have a case. Please do not wait to consult with an attorney. Texas has a two-year statute of limitations by which you must file your lawsuit within two years of the date of the incident. You can find a good personal injury attorney here on .
