In 2001 cps charge me with eminent danger to my 4 kids because a was married to a Dr. That was charge with dui , but 4 month later they return my kids back to my the natural mother he was the step father. Case was completely close in September if 2002 saying this case is dismissed and close from the court ducked. Now after 15 years I The cps has place under my care my granddaughter age 1 months 1/2 and after 13 month they ask me to do a Homefinding process and my case of 15 that I wasn't guilty of any drugs, abused directly to any of my children but yet they using that initial intake to remove my granddaughter and place with the natural mother who was trying to commit suicide 2 in 3 month and have a mister minor put in jell for lifting to the court and yet they said that is a better place. I have never see such of tragedies again a person that all alone never hurt one of my kids or done never drugs, never alcohol or any think agains the law but yet they removed her now 1 year and 2 month with the same allegations saying my home is not qualified to care for her??? Please is one out their can see why this is so wrong and what can I do other then plead the judge to place her back.

Unfortunately, there are no magic answers anyone here can provide you as no one here can know what is behind the thinking in the CPS decisions. I'm not hearing exactly that you are being denied because of an incident 15 years ago - the decision should be made on today's situation and perhaps there are other reasons they do not feel the child should be placed with you. Nevertheless, depending on the exact details of the 15-yr. old incident, it could still be relevant today if similar circumstances exist. Without seeing any CPS' written decisions or being part of the case, it is impossible to say what exactly the problem is. What is clear is that you need an advocate, and it would be best if you could find an attorney experienced in dealing with CPS. Ultimately, if properly brought before a judge by you seeking guardianship, a judge can decide these issues. Contact Legal Aid of WV and see if they can assist you. www.lawv.net
