Sobriety court is suppose to be a year long, I wanted to further my education down south and to get a fresh start on life, is my probation transferable and if so what do I have to do on my end? My probation officer told me she can't but another one said I can, I just want to know the truth.

You need to file for a transfer of probation under the interstate compact. The state where you plan to attend school must accept the transfer.

The answer to your question depends entirely upon the judge's discretion and underlying policies. In many courts, the judge maintains a strict policy that convicted motorists either complete sobriety court or go to jail. In other courts, however, sobriety court is a mere formality, and probationers find themselves released from the program early based upon a lack of a substance abuse problem. While no Michigan judge wants to limit your education or job prospects, those judges who maintain a strict sobriety court program are going to be less inclined to permit you to leave the state until a significant period of time has passed. You should begin the application for an interstate compact tranfer immediately. The process can take several weeks as some states are less responsive than others. In North Carolina, the application costs $150.
