My husband is 100% disabled and receives Social Security Disability and Medicare A & B. He is 46 & has 22 heart stints. Plus Many more Health problems. We recently married. I have 2 children from a previous marriage. I have been Unemployed (full time) for 4 years. And only received Unemployment for 1 yr. My husband recently Obtained 150K and Desperately Needs to Set up A Special Needs Trust asap. We are trying to sell My home where we Currently Live to Downsize and he sold his house this month. We need this money to purchase a home and pay bills until I can find Full time Employment. So We Don't Want His Medicare or his monthly SSD Cancelled in Case he Has to Have More Heart Procedures. Which Would Wipe Us Out Completely. We Need Expert Advice ASAP Please. How Do We Go about Securing the Money So We Don't lose everything if he has to have Open Heart Surgery?

Please consult an experienced local elder law attorney ASAP. Special Needs trusts and the procedures that must be followed are complicated. There may be alternatives to your current situation. Because counseling and preparing the appropriate documents is time consuming, these trusts are generally more expensive than most estate planning documents.
