How to change divorce proceedings into annulment. Pro Se litigant

Business 2 views 3 answers
Case has been filed with clerk of courts. How do I change it from a Dissolution of Marriage (Uncontested, no children, no property) into an Annulment (have major/substantial grounds). And how do I file my evidence/grounds with clerk? Do I write request letter to case manager, magistrate or judge? Do I go to hearing and explain to judge? Do I have to dismiss Dissolution and file new case for Annulment? And if so, can Pro Se do?

The Florida Rules of Civil ;procedure allow you to amend your pleadings once as a matter of right before any response is filed. If that is the case, amend you pleadings and file. If not, file a motion for leave to amend. Better yet, hire a lawyer who can advise you in this situation. Good Luck d

Based upon the questions you are asking, it is obvious that you don't really know what you are doing and need the services of an attorney. As Mr. Woodward correctly pointed out, you can amend your petition once, as a matter of right, before the response is filed. You will need to properly allege the proper grounds for an annulment in your petition. If you and your spouse cannot agree upon an annulment, then you will need to present evidence to the judge at a trial.
