Can I sue 10 years after a surgery?

Business 2 views 4 answers
When I was 14 I had major surgery, they saved my life, I then had a secondary surgery after they released me from the hospital when they shouldn't have. After the second surgery they re-broke my rib but didn't place it properly and it is sticking out very noticeably. It had never occurred to me to sue until recently, at the time it's something my parents should have done and I don't know why they didn't

Probably not, unless it was a situation regarding a situation where you did not discover there was malpractice and had no reason to suspect it. Malpractice has a 2 year statute of limitations, but because you were only 14, your SOL would run 2 years after reaching 18 in most states.

Statute of limitations hurdles are insurmountable and damages are inadequate to justify consideration of a malpractice action. Confirm with local counsel.

Assuming that your second (2nd) surgery occurred in the State of California, in which city and county did the second (2nd) surgery occur? On what date did the second (2nd) surgery occur? What is the name of the health care professional or health care professionals that performed the second (2nd) surgery on you? What is the name of the hospital in which you had the second (2nd) surgery performed on you? Can you please answer my questions at your earliest opportunity? Your answers to my questions would help me to better advise you. Thank you.
