My ex-wife still does not have a job since our divorce 3 years ago. What can I do to stop my financial leeching?

My ex-wife use to work for a large computer company, has a BS in business and 6 years of industry experience. She did not work after our son was born. Before divorce we agreed she should go back to work when our son started kindergarden. He's about to start the 2nd grade and she still does not have a job. After selling our house and her leeching off of my retirement, she is up 250K and I am under about 10K and whatever little is left in my retirement. The California family court has done nothing to get her back to work. I only get my son 15% of the time. I can no longer afford a lawyer and could barely keep my head above water even though I make a six figure salary. Help!!! If there is no hope, can someone please just shoot me and take me out of my misery. Thanks.

Although you are not able to afford hiring an attorney you should still find one that will meet with you for a low fee or visit your local legal aid. You can find your local legal aid by contacting your county's bar association. You should request that the court order a vocational evaluation of your wife. If the court orders a vocational evaluation the court may impute an amount of income on your wife which may lower your spousal support responsibilities.

Did the court put her under a seek work order or give her a "Gavron" warning? If so, and she has not been obeying these orders, you should file for contempt of court. Is this temporary spousal support or permanent? If if is temporary, seek to get a trial ASAP. At trial, the court will set "permanent" support (not support forever, just support set using the factors of Family Code 4320). Permanent spousal support is lower than temporary spousal support in 95% of the cases. Contact me if my answer is not clear.
