What is it considered when you are at fault in an accident but you were involved in the accident due to road harassment?

I was involved in an accident where I was coming up to a green light that had been green for a good amount of time and the final cars were filtering out. I had a large dump truck behind me and on my side coming ever so slightly into my lane to make it clear that they wanted to be where I was. I was not following too closely to the car in front of me and I was slowing down to accommodate the people in front of me because they had not gotten up to speed yet. I looked in my rearview mirror at the dump truck which appeared to be coming in too close behind me and not slowing down enough for the large size of the truck to make the stop. I was scared I would have to do an evasive maneuver in the median. I looked ahead and the truck in front of me had come to a full stop and was the last in an accordion of people who had to stop because of a car three or four cars in front. They guy in front of me said that he had not been following too closely either and narrowly missed hitting the truck in front of him. Legally, how could I defend myself in court for a "following too closely" ticket? I was distracted by the dump truck threatening me and did not know I was too close until I already was.

You need to hire local counsel to fight the traffic citation in court. My guess is you will probably not be assessed fines and costs based on your story but likely to be found guilty of the violation.

Your best bet would be to find local speeding/traffic ocunsel to help you fight this ticket.

You would be well advised to hire an attorney to advocate for you and prepare you for telling your story to the Judge. No one can predict the exact outcome, but your chances are better with an attorney. Dr. Michael G. Sribnick, Esq. criminal defense attorney in Charleston and Columbia, S.C. Michael G.
