Is this a type of discrimination or unfair treatment from an employer?

I've been working at this company since last September, I drive tri axel and my employer has been letting all of the other employees work except for me. All of the employees were laid off for winter since there was very little work. I am the only one who can not collect unemployment and I have begged my boss to give me work but he constantly sends out guys who have less experience than me. So when I spoke with HR they made sure to get me on a few days here or there. However my boss just hired two new guys in the past month and has them working constantly while I have been there longer than them, and have more experience total. I am afraid to go to his boss, because I have no idea if he may try to fire me or make it harder to get work. Is there anything I can do?

Sounds like you are getting treated differently. The question is whether it is for an illegal reason. Are you new? (not illegal) Are you younger than others? (not illegal) Are you black or other minority? (very potentially illegal) Are you a woman and all other people are men? (very potentially illegal) Do you have a disability or health condition? (potentially illegal) -- I agree with other posting that an attorney needs more facts to decide and best idea is to contact an attorney who does plenty of employment law
