On March 6, 2017 a family member complained of breathing problems, chest pains, weakness in legs, cold skin but feeling hot. Anbulance was called . Took about 15-20 mins to come. got there , checked him out for about 5 mins, assumed maybe hyperthermia etc. Pupils were dilating. Asked if he could sit up by that time he said his back was in pain. According to friends, they didn't administer oxygen and took him out sitting up on the stretcher. Took him to hospital sometime after 9pm . By after 11 he was pronounced dead . death cert says he died after 10. I was on phone with a friend who was at the hospital when doc came to ask to call person he lives with to say it does not look good so come asap. was already after 11pm, yet certificate says he died after 10.. when my friend got there at ER they were pumping deceased chest with bare hands and chased everyone out of room. a young lady said "y'all chasing us after y'all left him to die". Another person also told family members the deceased machine was flatlining for about 20 mins before they responded. Nurse told decedent sis he came with back pain and she had more serious case. Pre autopsy says enlarged heart. We await final autopsy

Your instincts are correct. It is critical to have an autopsy done to determine the cause of death. That, in turn, will tell you whether the death was preventable. Good luck.

In NY State statute of limitation alleging wrongful death two years from the death and lawsuit can not been filed until an administratrix has been appointed by the court.

Get local malpractice counsel involved so we can review the records and autopsy report and determine if there is a basis to bring a wrongful death/malpractice action. The statute of limitations for wrongful death is two years and for malpractice two and one half years.
