I was in a car accident few months back. My boyfriend was driving the car and the car insurance had expired.

A friend of mine died and her family is trying to handle the matter legally. What is the worst possible scenario my boyfriend may face? He had a driver's licence and was not drunk.

That is a very tragic story that I'm sorry to hear about. Unfortunately, when you drive with no insurance you open yourself up to personal exposure for harm caused to others. If your boyfriend was the at fault driver then his is personally liable for injuries and damages caused as well as the owner of the vehicle if your boyfriend was not the owner. The family of the deceased party can pursue a claim for wrongful death against your boyfriend (and the owner of the vehicle if not your boyfriend). Whether or not he has any assets for them to pursue is another question. He should definitely seek the advise of local personal counsel that handles civil defense litigation.

He is facing potentiallly both civil and criminal charges. There is a wrongful death suit likely. That entails financial consequences resulting from her death. He is also looking at criminal charges based on the facts of the accident. The charges could range from misdemeanor to felonies.

I am very sorry to hear about your loss and the tragedy that has touched everyone involved here in our community. As mentioned by others, the driver faces potential criminal charges. There is also the possibility of a civil suit, but at this point in time that is probably the least of his worries. Pretty much all involved need to meet with an attorney to see what their respective rights are legally and how best to move forward.
