Immigration judge and I 751 ?

Business 2 views 2 answers
A friend of mine, who is in immigration detention filed for I-751 with USCIS. The immigration judge keeps on asking can the I-751 be transferred to him, so that he can make a decision over it . The USCIS officer at customer service number told me that USCIS has the authority over I-751. Why then the judge keeps on insisting for I-751 to be transferred to him?

The IJ is wrong. First USCIS must approve or deny the I-751 before the judge can consider it. Get a lawyer.

Hast it been denied? In that case it should be transferred to the IJ. I suggest you hire an immigration attorney.
