How do I file for divorce w/o my spouse signing the papers?

Business 5 views 2 answers
I want to file first & hope that he procrastinates (as typical) & then I'm awarded the divorce uncontested. He hid money from me during our marriage ($20k+), cheated & was emotionally abusive - all of these things can be proven. If he contests I cannot pay an atty therefore no atty wants to help me fill out papers. I work 2 jobs to cover the mortg & the repairs he left me with. Any suggestions? I've reached out to legal aid but do not think my income qualifies. The IRS is about to put a lien on my house for back taxes from the business he's keeping. All I want is for him to be responsible for paying the taxes, nothing else. House is in my name, business is in his, already divided everything, married 4 years & no kids together.

You might contact a local Low Income Taxpayer Clinic to see if they can help you file an Innocent Spouse petition with the IRS. This, if successful, would prevent a lien being filed in your name.

There are some very helpful forms on the TN Administrative Office of the Court website for divorcing couples. You might refer to those documents to provide guidance in filling out the needed forms. Once the divorce is filed, you may want to request or "motion" the court for temporary relief related to compelling your husband to pay such taxes.
