I became a Victim of Medical Malpractice and a Victim for Profit. In 2012 I was not able to get Justice. I have two questions?

When I became a Victim I was left with Rubral Tremors(which your cerebellum had been damaged). Which I was talked into because I was having pain and swelling in my Legs and Feet. A High Risks and Unnecessary Surgery and they had No Clear Cut Diagnosis of what was causing the problems. So I was talked into 11/22/11. In 2013 I had to have a Deep Brain Stimulator placed to control the Rubral Tremors. I was told, when placed that the battery had a life span of 5 years. It died in 8 months. Had to have a surgery to replace it. Now the device does not work at all, now and the Rubral Tremors are back like they were before when I had they first botched the surgery. I met with the rep from the company and the neurosurgeon and neurologist and they all know about the device not working. Would it be a defected product. I was told I would have to have a 3rd surgery to prove it. Even though the FDA had recalls on this device as of May 2016. Next question. While I was going through this ordeal with these hospitals and not being able to have rights. Was my Civil Rights Violated as a patient?
