My boyfriend got pulled over for driving with suspended license knowing and this is his 2nd defense in 4 years. His son contacted him due to he had surgery and the person who was supposed to drive him home didn't show up and he didn't have anyone else to drive him. The officer stated he pulled him over because he was not wearing a seat belt and I know my boyfriend had a seat belt on he won't even let me back out of the driveway without it on . But when the office came to the window he was honest with the officer and advised his son was just put under anstheia and the officer gave him a ticket for court and made his son drive home. Is there anything we can do about that and also what could be his consequetions

1) You were not in the car so you don't "know" what happened in the car when you were not in it. 2) Your b/f has no business driving w/o a license. Period. You b/f 's has options. Friends, Uber. Stay put. The option that does not exist is for someone who's driving privilege has been suspended to get behind the wheel of a motor vehicle. Do not discount the fact that DWLS can become a significantly bigger problem. In Fl your beau can be designated a "HTO" (habitual traffic offender) for racking up 3 DWLS's, and, once "habitualized" you not only earn a five (5) year driver license revocation but the next one (the fourth - 4th) subjects your b/f to felony prosecution and five (5) years in state prison. Note also that the only thing that pisses off prosecutors (and Judges) more than folks who commit crimes are folks who commit the same crimes over and over, like your beau, and the same holds true for cops (frankly, your beau is lucky that he did not end up in jail). That said... 3) Yes, there is something you can do, 2 things in fact: A) GET OFFLINE (caps intentional) and into a skilled and experienced Panama City area criminal defense lawyer's office. Use the "Find a Lawyer" feature on to locate proximate lawyers, make an appointment, show up on time, bring whatever evidence, documents or witnesses that you may have, engage in a meaningful face-to-face consultation and get yourself some advise which is legally sound and has been custom tailored as possible to meet your specific reasonable needs in your unique case. & B) Take the car keys away from your beau. Wishing your b/f luck and hoping that I have been helpful in answering your question.

Unfortunately, your boyfriend broke the law. If he had been rushing his son to the hospital for some emergency rather than picking him up at the hospital after he was released to take him home, he would have had a valid defense. I believe you when you say your boyfriend had his seat belt on. Any criminal defense attorney can tell you stories about the questionable but common police tactics to establish probable cause to stop a car: no seat belt; smell of marijuana; tag light out; etc. Fortunately, a second DWLS is a misdemeanor. If he gets a third knowingly driving without a valid license, it is a third degree felony. This could make him a convicted felon and subject him to a potential prison sentence. Get in touch with a lawyer to get him through this current charge and more importantly, to help him figure out why his license is suspended. A hardship license might be something for which he qualifies in the short run.

Your boyfriend needs to hire a lawyer to represent him on the criminal charges he is facing. I wish you and your boyfriend well and hope my answer is helpful.

This is his second criminal charge for driving on a suspended license. It is not good. He needs to get an attorney to help him with this in order to minimize his consequences and the attorney will help him figure out what he needs to do to reinstate his DL. Wishing you good luck.
