Wife and I are separated preparing to file divorce, she keeps calling and texting about getting rid of pets.

Sunday night, my wife brought her bf (we are still married) to our house, and in front of our 2 children this guy got physical and started punching me. Police arrested him, and an investigation is under way. I was able to take my oldest child away from the house and situation, and have stopped contact due to her calling over and over. She calls my grandparents house a lot, has threatened to call my work, and started texting me continuously today. First text she threatened to have our 2, 4 year old cats put down. While she offered for me to take them, my daughter and I are in a safe place away from the assaulted me (I was holding my daughter the first time he hit me, scraping her neck btw), but the residence does not allow pets and she knows this. She finally texted and said they are at the pound now. Is there anything I can do about this? I'm tired of being harassed by her, but don't know if this is grounds for harassment. I currently am looking for family attorney who accepts payment plans and handles Johnson County, Texas, divorces (contested, needing temp custody, restraining order). My daughter will be devastated that the cats are gone, as she loves them dearly.

A lawyer might be able to secure a TRO in connection with divorce proceedings, but probably not in time to keep the cats from being euthanized if in fact they are already at the pound. Not to minimize the pet issue, but the cats are not the priority right now. You must do what's necessary to protect your children and protect your rights, and that includes talking to a family law attorney in your area with experience handling contested cases. Having the family pets put down will likely make her appear vindictive and inconsiderate of the children's feelings, but the assault is the major issue. Obviously, your children do not need to be exposed to such behavior, and her choice in a boyfriend will likewise not portray her in a good light. Try to gather enough money to at least schedule a consultation with a family law attorney in your area. Some attorneys even do free consultations. Good luck to you.
