Does it make sense to retain a lawyer to file a motion of reconsideration?

My brother is currently incarcerated in Kilby Correctional Facility located in Mt Meigs, AL. in March 2010, he violated his probation and was sentenced to serve out his probation period against a 15 year sentence. He currently has a parole date of 10/2012, however, he has been approved for prison work release. He has asked my mother to retain a lawyer to file a motion of reconsideration so that he can receive an early release. My mother and I are trying to determine if it is logical to retain a lawyer if he has been approved for work release? Does work release mean he will be getting out soon?

Usually “work release” means he is let out to go to work, then has to come back right after work; in other words, its like living in jail but still going to work. I agree with my colleague, but I would recommend that you consult with an experienced criminal lawyer in your jurisdiction about the cost and advisability of retaining such an attorney to seek a reconsideration of sentence.
