Can I sue my chiropractor for a hairline fractured sternum?

Business 3 views 3 answers
I had an appointment with my chiropractor to see if it would help my Parkinson's tremors. After one particular adjustment with his full body weight on me I felt a strange pain. I went to work after and couldn't even put a cover on a marker without pain. I called the chiropractors office to check if this was normal and he said to just put ice on it. It didn't improve so on the second day following the appointment went to Express care and had an x ray that confirmed I had a hairline fracture on my sternum. Now I need to follow up with my PCP today for restricted activities and care.

You possibly have a medical negligence claim; however, because the system is so time consuming and expense, it would be uneconomical to pursue. The expense of the claim would dwarf what you could reasonably expect to recover as damages.

Sure you can sue. Breaking your sternum was not acceptable chiropractic care, even though there is certainly a risk of fracture inherent in many chiropractic techniques. Chiropractic malpractice is something that most medical malpractice attorneys have handled from time to time, so finding an attorney familiar with this type of suit will not be difficult; however, in this case the potential damages associated with the suit would be limited. This non-displaced fracture will not require extensive treatment or surgical correction. It hurts and limits activity but not permanently. Ultimately this should get better on its own with time and careful limitation of activity, Your Parkinson's is a complicating factor as well because of certain risks and realities associated with it. I would advise that you not sue, but rather, if you are angry file a complaint with the New York Department of Health.

Depending on your actual limitations and damages this may be worth consulting with local malpractice counsel.
