I was driving on 91 late at night. I believe I fell asleep. Woke up in the hospital. I had a .15 BAC upon admittance of hospital. I hit one vehicle and came to rest under a trailer of a semi. The driver in the first car I hit complained of neck and back pain at the scene. Passenger in the same vehicle had not injuries no complaints. Semi driver had no injuries. Would this be considered a felony dui??
It could be filed as a felony. The Riverside DA’s office is very harsh to DUI offenders that get into accidents and hurt people. I cannot guarantee if it will be a felony or not, either way you will want an attorney. Riverside requests jail time on every DUI and therefore they will want even more for you. Get an attorney to assist you.

Honestly, no attorney can promise or guarantee whether or not your case will be filed as a felony of misdemeanor from what you have wrote.
What you need to do is hire an attorney as Mr. Driessen has suggested so they can go over your case with you and the possible outcome. Riverside County is very strict about DUI's and as Mr. Driessen stated, they'll probably want jail time out of you. Either way, you need to contact an attorney as soon as possible.
Remember, you only have 10 days from the date of incident to contact the DMV to schedule an Administrative Per Se Hearing.
