Walmart likes to wear people down. If you decide to continue to represent yourself, be prepared for more of the same. I encourage you to hire an attorney.

Speak with an attorney who has handled claims with Wal-Mart. In my experience, they will require that you file suit to receive a fair resolution. Most attorneys who handle slip and fall cases offer free consultations and contingency fee arrangements. That ensures you owe no attorney's fee unless Wal-Mart pays a verdict or settlement.

You should hire a personal injury attorney to represent you. Most of those cases are handled on a contingency fee basis which means you do not pay an hourly rate to the attorney - you pay the attorney a percentage of the gross recovery. You also are responsible for paying case expenses. Wal-Mart fights these cases aggressively. You need an attorney who has the experience and expertise to handle your case against Wal-Mart.

Do not speak with Walmart or give them a statement under any circumstance until after you have spoken with your attorney. You should obtain needed medical care and treatment immediately and follow the doctor's advice. Do not give any statements to the adverse party or insurance company nor grant them access to any medical records. Photograph the injuries and the damage done to any property. Contact a personal injury attorney in your area as soon as possible so that you can protect your rights. Walmart will not follow up with you most likely. The law in NC is very tough on slip and fall cases such as this. There are tough liability issues and contributory negligence that Walmart is very effective at applying to their advantage. I suggest hiring an attorney that has handled these types of cases. Beware, many attorneys will not handle these cases because they are so challenging.

Walmart is notoriously litigious and has been known to stonewall. You may wish to contact the manager and ask if they have medical payments coverage that would help cover medical expenses. Likewise, you may wish to talk with a local personal injury lawyer with a history of fighting Walmart as usually a suit has to be filed before they will even pay any attention to your claim. The downside is that you need to get medical treatment as soon as possible if you are injured or it will be difficult for your lawyer to prove the treatment was causally related to your injury.
