My spouse and I have not lived together as a couple for at least five years. He does not respond to multiple requests from me to meet in the interest of working out a settlement for an uncontested divorce. I am afraid he will not sign papers in a timely manner when necessary. He is in another state and has said he will return to discuss a settlement, however, he has yet to do so. No children are involved.

If he is not willing to work with you, you are left with simply filing for divorce and seeing where things go. The best thing to do is get with an experienced family law attorney to review all of your facts and papers.

I agree with my colleague. You need to file for dissolution here before he tries to file where he lives. If there is nothing to fight over, it should be fairly simple. You do need to serve him in a manner acceptable in the state where he is residing.

I agree with my colleagues. If he will not cooperate or sign a settlement agreement you made need to just file a Petition for Dissolution of Marriage and have him served. He can then either choose to participate in the process or the court will move forward without his input. I would consult with and retain an experienced family law attorney in the Tampa area to assist you with this matter. I wish you the best of luck.
