My wife hit me one night repeatedly I didn't file a report then next night she pressed charges on me can I still press charges?
I'm being charged with domestic assault even though the first night i was assaulted.

You don't "press charges." You file a report with law enforcement. Law enforcement will decide whether to pursue it.
I can tell you, though, that they see this tit for tat kind of thing all the time. If you had an opportunity to file a complaint and didn't do it, why do it now?

She does not have the legal authority to press charges on anyone. She can file a police report and they will handle the it from there. Can you still pursue? That is your decision, but since you did not call police at the time, they may pursue any criminal action. You need a criminal lawyer.

People don't press charges. The police investigate/arrest and then the prosecutor files charges. A police report was filed. I would talk to a criminal defense attorney immediately.
