Wife and I are divorcing. She recently dropped me from health care insurance as I was covered thru her plan. What are penalties and what can be done to her employer for allowing this illegal activity as she is employed by a local public school.

You can deal with it as part of your divorce. The court may be able to order the wife to add you back or order the wife to pay for insurance from the private marketplace until the divorce is over. It sounds like your divorce is contested. You should consider hiring a divorce attorney.

If you aren’t represented by an attorney, now would be a good time to retain someone to represent you. Removing you from her health insurance in the middle of a divorce case is, at the least, a violation of state law, but may also be against a local rule in your court, as well. A Motion for Contempt may be in order, and a family law attorney will be able to sit down with you and review your situation to determine the best course of action for you.

Section 452.317 of Missouri law provides that from the date of filing a dissolution action no party shall terminate coverage during the pendency of the action of any existing policy of health insurance. Contact an experienced family law attorney in your area to file for relief from your wife's prohibited conduct and do so immediately. Take care.
