How do I go about evicting my daughter?

My daughter has been living off of me for about a year. She is 23 and she has a place to live but won't move down there. How do I go about kicking her out? Should I type out a eviction notice? Help!

If she's not a joint owner and she's not on a lease with you (or she's violating the terms of a lease), you can evict her.

As a lawyer I can tell you that you are entitled to evict her. As a parent, I strongly encourage you to seek other means to come to an agreement.

If you do plan on evicting her you must provide her with some notice ( assuming she is a legal tenant) who hs signed a lease. If she refuses to leave after that you can seek court process.

If you feel you must evict her then you should give her a written notice to quit. If she has not left then you can file a eviction complaint in the local magistraterial district court. You will have a hearing within 10 days. Once you have a judgment of possession and no appeal is filed then the constable will come to the house to evict her.
