Can I sue the roofer?

My husband who does not speak or read English, and he signed a contract with the roofer. After that, he was trying to cancel the contract, he tried to contact them, but the person who sign the contract could not be reached out. 2 weeks later, we received a voice message and telling as that they scheduled the material to be delivered to our house the week after. We then called the Representative right away, and told him to moved out the material delivery date to 8/15, since we were on vacation, and he agreed to. I came back from vacation on 7/21, and received a bill for $17k, which the claim that they sent to the insurance company was only$1,000. I call the customer service, and they told me the person who handled my account has left the company, and there is a new account manager taking care of our case. I called her, and she was rude, and screaming on the phone, and telling me the roof has been replaced on 7/3. She told me that I have to contact my insurance company, otherwise we will have to pay this by ourselves.

Roofers like that are horrible. They are frequently very high pressure on sales, then never want to give up their profits. It sounds like you may have some real defenses to their claim. What you didn't say was whether the roof was actually rep[laced as they claimed (even if their date was incorrect--7/3 when obviously the material was to be delivered on 8/15). You need an attorney now to review the contract and find out what you really want to do, if this situaation can be fixed and who, if anyone is going to replace your roof. Check 's Find a Lawyer for a local construction lawyer who also has strong consumer law experience. YOu might also want to check the Pros for that mix if practice area.

Agree with the other poster, you need to have a discussion with an attorney regarding the facts and circumstances of the matter.
