Before filing for divorce my exhusband took $40-80k out of our 401k to pay for his divorce and spend on his girlfriend. This I found out after our divorce was final. Am I entitled to half of this money? If so how do I go about getting it?

It depends. Why don't you contact your divorce lawyer. If he didn't hide it- you just didn't do discovery, you may not be entitled to anything. If he hid it and did not disclose those facts although he was required to, such as in his discovery responses or his inventory and appraisement, then you may be able to reopen the divorce property division. The longer you wait the less chance you have.

You need to spend a little money and time with a lawyer to review your divorce paperwork. There may be a way to get the money--if he concealed it from you, lied to you about it. Without a lawyer, you have zero chances. With a lawyer, maybe.

It sounds like you need an attorney. Money / property aquired during the marriage is subject to division. What an attorney can help you do is 1) figure out what the marital estate is 2) what you are entitled to 3) how to get it. These are very involved and detailed oriented conversations that should be a discussed with an attorney who can go over the facts of your case and help you figure out how to get from point A to Point B.
