Can I change my asylum green card to marriage based green card after getting married to us citizen ?

Business 2 views 6 answers
My asylum is approved 2 years ago, and I have green card since then. I am getting married to US citizen at the end of the year. How can I adjust my green card to br marriage based, instead of asylum? Should I do that, or just wait for few more years to get citizenship through asylum? Or I am required to do that, because I am changing my immigration status? How long does this process takes and how long do I wait fir citizenship? From day when asylum green card is apprived or date I got marriage green card?

You should NOT attempt to do that, for if you try, and assuming you succeed, you will be getting only a "conditional" and "temporary" permanent resident status, instead of the unconditional, permanent one based on your granted asylee status.

You can only have one immigrant file at a time. You are already an LPR, what would be the basis of your application exactly? Goodluck. Ekaette Lawyers

Stay with asylum. You should have applied for an received your green card by now.

US citizenship through naturalization would require US citizen marriage for 3 years and residence together. It would make sense to file for natz based on asylum. You may be able to roll back your green card date on asylum for natz.

You can apply after three years so long as you are living in marital US citizen spouse. It does not matter if you received your green card through asylum. You do not have to wait 5 years merely because you received your green card by way of an asylum application. Use a lawyer when the time arrives. Have a good day.
