Can I visit USA on my B1/B2 visa after marrying a US Citizen?

Business 4 views 6 answers
My husband is an US citizen by naturalization. We got married 1.5 years back outside USA, in our home country. Before marriage, I travelled to USA on tourist (B1/B2) visa and returned within 2 weeks. That visa is still valid till 2020. Now, I plan to visit USA again on my tourist visa, will their be any issue of declining entry at the airport Immigration point? My husband has not yet applied for any immigration visa for me till now.

Yoiu can travel on a valid visa, and disclose the fact that you have a USC husband should that question arise at the port of entry. Goodluck. Ekaette Lawyers

A B1/B2 visa is a non immigrant visa. If asked if you are married to a USC and you inform the officer s/he may suspect that you are not visiting but intend to remain in the USA with your spouse. Carry with you documentation to show that you will be returning to your home in your country upon the expiration of your allotted visit.

Often it is difficult to establish the requisite level if nonimmigrant intent for a B visa entry when you are married to a US citizen. It IS possible. But in the real world be prepared for secondary inspection and possible denied entry. You should discuss this with an immigration lawyer fir best results.

You really, really, really need to discuss this with a Board Certified immigration attorney, or your husband does, and not discuss it further on a public blog. Good luck.

There is always a presumption of immigrant intent, i.e., that tourist isn't really a tourist because she plans to stay in the US. The presumption is even stronger for you, since you already are the wife of a US citizen. To overcome the presumption you need proof that you won't stay in the US.
