WA State: Can heirs dispute a claim leveled against the Estate, if it's the Personal Representative who is claiming it?

The Personal Rep of our father's estate recently procured altered documents (we've had them examined by expert witness/forensic specialist) of shares from our father's company, claiming 50% of his assets. Since she sold all his assets days before his death, in the company's name, the liquidated business assets ARE his estate. I've written about this in a prior post. We wonder now, as heirs, can we dispute this claim, so the court retrieves the proceeds she's collected (RCW 11.76.190) to keep them safe until we untangle everything? And if so, can anyone tell us what form we'd file? I appreciate your advise and time!

I'm a NY attorney and can't advise you as to the laws of your state. I can tell you, however, that if you are alleging improvidence (a fancy legal word meaning dishonesty) of the executor, together with a possible conflict of interest by that executor, you really should not be trying to do your own lawyering. Hire a local attorney. Good luck to you.

You have now entered into the territory where you must retain an attorney to assist you. A "form" does not exist. The reason this is such is that each situation is fact specific. As a minimum, contact a probate attorney and explain your situation. Many have free initial consultation. has a "Find a Lawyer" feature that will assist you in locating one near you. Good luck.

I agree with Mr. Haber that you definitely need to hire an attorney, rather than trying to handle this on your own. I would add that time is of the essence, so you should hire an attorney ASAP. Once your father's assets have been spent or otherwise disposed of, then you will have no effective remedy, even if the law is on your side. Good luck!
