08-04-10 Today was my Arraignment for my DUI back in 2004, I also had expired plates and no proof of insurance for that arrest. I did not appear in court for this, however my fines are paid in full. In 2008 I was pulled over and received a ticket for driving under a suspended license. Today I decided to represent myself in court for the later date. Is there anything I can do to prepare for my case? any advice? i am scheduled for a pretrial conference before trial, how should i go about this? is there anything i can say or do to come to an agreement of a lesser charge via DUI classes, community service?

It's probably not what you want to hear, but honestly, you need to hire a lawyer for something like this. It's just too complicated and I don't see how you can adequately represent yourself on something like this. Or at least not perform nearly to the level of an attorney. There is too much at stake and risk here. You are facing points on your license, driver's license suspension, vehicle immobilization, fines and costs, probation and/or jail time. It's not worth the risk to go it alone.

Depending on whether this is a first offense or a subsequent offense the penalties will vary. These can range from zero or a few days of jail time with less than $1,500 in fines plus court costs, probation, license suspension, community service, and vehicle immobilization or an ignition interlock device to several years' imprisonment, long term revocation of driving privileges, seizure and sale of your vehicle, fines totaling several thousand dollars plus court costs. Having a criminal conviction such as OWI or even DWLS can effect you in more ways than one. You should retain an attorney NOW before you walk into Court at the Pretrial hearing. If you truly can't afford to retain an attorney, you ought to ask the Judge for a court-appointed counsel. Best of Luck. Dan Hajji .com
