Can I claim my share of a house sale?

Business 8 views 2 answers
5 years ago, I got divorced. The judge awarded the house to my wife. My lawyer created a Special Warranty deed that I signed/notarized. An unsigned likeness of this was in the decree. My wife claimed she never received the deed, so her lawyer had me sign/notarize a General Warranty deed. She filed it at the county clerk's office. She sold the house late last year. My lawyer recently "found" the Special Warranty deed (dated before the General Warranty deed; but never filed). He said that because the likeness was filed with the decree and that my ex knew about it and didn't received it - THIS is the superior deed in Texas. Can I use this deed to sue for my half of the property?

You should ask your divorce attorney this austin because such attorney is familiar with the relevant facts.

No, you have no interest in the property per the divorce decree and either of your deeds. The only difference in the 2 deeds is the degree of "warranty", but the conveyance of all of your interest is the same. She gets it all.
