How can I get the spousal support to my ex wife lowered?

Business 3 views 3 answers
My ex-wife works as a hairstylist and falsified the amount of money she makes on a monthly basis. She only works part time(3 days a week). A gavron admonishment was issued to her. Her support was also calculated using her two children from a previous marriage as a hardship. However her ex-husband and her have an equal among of custody per their divorce decree. Her ex-husband also has a full time job and she chooses not to seek child support from him and instead used our divorce to obtain additional support from me. Any advice would be greatly appreciated. Thank you.

There is typically a petition that can be filed to modify child support if there is new information that warrants a change. If you can prove everything that you claim, then you should be able to obtain a modification. You will need to consult with a local lawyer or go to the family court where the child support order exists and see if there is a lawyer who assists walk-ins to file. Your best bet is to hire your own attorney, however, if you can afford it. Good luck

It depends on many facts such as how much time has passed since original order, her circumstances when the order was made (was she working then?), and whether she's made efforts to become self-supporting. You can ask that the court imput full-time income to her based on her reliance on her current husband enabling her choice to work only part-time.

First, you should consider consulting with an attorney licensed to practice law in California. Be cautious of advice from attorneys outside of California. Second, there is much more information needed to adequately respond to your question. Are you only looking to lower spousal support? Is there an issue with child support as well? How long ago was the judgment of divorce entered, and how was it entered? It would probably be best for you to consult directly with a California licensed attorney and bring copies of your documents.
